Wok Express Terms and Conditions

On-line Ordering

Wok Express provides an on line ordering website for ordering food for delivery or pick up from a store of your choice

We do not retain credit card or other payment details.

Wok Express agrees to fulfil orders as per the terms and conditions but reserves the right to reject any order in its discretion.

If you place an order online you acknowledge and agree that Wok Express is entitled to assume that any Order which is placed with Wok Express via the facility using your details and which is accepted by Wok Express is a valid Order on your behalf for which you are obliged to pay.

You acknowledge that:

The website is provided in good faith, but Wok Express cannot guarantee its performance or availability. The website may be unavailable from time to time for scheduled maintenance and or upgrades  and as there are inherent hazards in electronic distribution and as such Wok Express cannot warrant against delays or errors in transmitting data between you and Wok Express including Orders, and you agree that to the maximum extent permitted by law. Wok Express will not be liable for any losses which you suffer as a result of the Facility not being available or for delays or errors in transmitting Orders

You acknowledge that:

Upon submitting your order you are responsible for the costs associated with that order.

If you choose to pick up an order and not turn up to collect and pay that you are still liable for the costs of the order.

If you order from the wrong store location you are liable for the cost of that order if it has already been prepared. Placing an additional order at the correct location you wanted is not permitted unless the other order you placed is paid for.

Please note that the delivery times and pick up times provided are estimates only. Due to the unforeseen nature of demand Wok Express does not guarantee delivery or pick up times as delays beyond our control may be experienced.

Wok Express reserves the right to cancel your order and any future orders if it learns that you have provided false or misleading registration information, interfered with other users or the administration of Wok Express services, or violated these Terms and Conditions.

You may not at any time be the holder of more than one registration with Wok Express whether by use of your own name, the use of aliases, or some combination thereof.

You agree to fully indemnify and hold Wok Express harmless from any claim, cost, demand or damage (including legal costs on a full indemnity basis) incurred or which may be incurred arising from a breach by you of these Terms and Conditions of Use

 

Reviews and Comments

Wok Express enables visitors to its web site to post reviews of and comments on this web site. If you post reviews or comments on this web site, you grant Wok Express a right to use, reproduce, modify, distribute and display such reviews and comments throughout the world in any media.

Wok Express reserves the right to amend or delete any comment which it considers to be obscene, defamatory or untrue.

Disclaimer

Your use of the material contained on this web site is at your sole risk. Any information and data is provided on an as is basis and excludes any warranties which may be excluded by law. Wok Express reserves to itself the right to change any of the material on this web site at any time.

 

Cancellations

Orders can only be cancelled by phone and only to the relevant store in which the order was placed. Wok Express can only cancel the order if it has not been commenced. Please note that in off peak orders this may mean immediately therefore the order is unlikely to be able to be cancelled.

You agree that once the order is submitted that you are responsible for the cost of the order and services and it may not be able to be cancelled.

Refunds/Credits

If you did not love your meal then please let us know. Any issues with food quality need to be reported upon receiving the order as we reserve the right to inspect the order if required.

Please take a photo of the food or order to support your complaint and email it to us if requested as it helps us to improve our services and systems.

Please be aware that while we will do everything from our end to complete this refund as soon as possible it may take up to 3 business days depending on your financial institution and the transaction type ie. Credit card.

Allergies

Allergen free or gluten free orders

Please state in the special instructions if you have an allergy when you order or let us know verbally if you order by phone or in person at the store.

Wok Express will endeavour to provide gluten free or allergen free food if requested by you, but traces of allergens or gluten may be unintentionally present in food due to cross-contamination during store operations. We cannot guarantee 100% that our food is allergen or gluten free.

 Wok Express cannot be liable for any costs whatsoever, including medical costs, if a customer has any adverse reaction to a Wok Express product
